Terms of service

1.What the Service is

WinMyBids extracts and organizes information from solicitation documents you upload and presents it as a report with citations to the source pages. Where you purchase Bid Pricing, the Service also builds a price estimate from that information, the rates you enter, and public market data, and labels every figure with its origin and a confidence level. Where you purchase the Response Pack, the Service generates proposal drafts and checklists from that report as a Word document delivered with it. The Service is a document-analysis, estimating, and drafting-assistance tool. It is not legal, financial, or bid advice, it does not submit proposals, and it does not guarantee that a bid will be competitive or win. You remain responsible for reading the solicitation, verifying findings and figures against the source, completing and signing any draft, and every decision you make about whether, how, and at what price to bid.

A priced bid is an estimate. Figures labeled as our estimate are derived from public data and industry production rates, not from your books, and may differ from your actual costs by a material amount. We do not guarantee that any price will cover your costs, be accepted by a buyer, or win an award. We do not use other customers’ rates or bids in your estimate and never provide a shared price target to competing bidders.

2.Who may use it

The Service is offered to businesses and the people who work for them. You must be at least 18 years old to use it, and you may use it only for business purposes, not for personal, family, or household purposes.

3.Free preview, paid products, and plans

You may upload a package and receive a free preview without an account, subject to a daily limit on the number of previews per connection, and you may use the bid calculator for up to two sites without an account. Unlocking the complete report, with or without Bid Pricing, requires a one-time payment at the price shown at checkout, or a report from a plan you hold. Only products with a purchase button at checkout can be bought. A one-time purchase never renews and never enrolls you in a plan.

Bid Pricing Pro is an optional subscription billed monthly or yearly at the price shown when you start it. It renews automatically at the end of each period until you cancel. You can cancel at any time from your dashboard (“Manage billing”); the plan then runs to the end of the period already paid for and is not charged again. Pro includes a stated number of Bid Intelligence Reports per month; unused reports do not carry over. If a renewal payment fails, we retry it, and the plan ends if it cannot be collected. We will give you at least 30 days’ notice by email before changing a plan’s price. The Bid Season Pass is a one-time purchase that includes a stated number of reports and the Pro tools for 90 days; it does not renew, and unused reports expire with it.

Each paid report covers one solicitation package. For 30 days after purchase, we will re-analyze the package with an addendum included at no extra charge; for now, email the addendum to hello@winmybids.com and we will run it for you.

The Response Pack is an add-on generated from the finished report and delivered with it as a Word document. Its documents are drafts for you to complete, verify, sign, and submit; we do not guarantee that a proposal built on them will score, comply, or win.

Payments are processed by Stripe, and Stripe’s own terms apply to the payment itself. We never see or store card numbers.

If processing fails and we cannot produce a report for a package you paid for, we refund the purchase automatically.

4.Refunds

If a paid report misses or misstates something material in your package (a deadline, a mandatory requirement, a required form, a contract term), or a priced bid does not follow the structure of the buyer’s price form or misreads the scope in your package, email hello@winmybids.com within 30 days of purchase and we refund it in full. If processing fails and we cannot produce a report, we refund the purchase in full. If we cannot deliver a purchased Response Pack, we refund that add-on. We do not refund because a bid was unsuccessful, because you decided not to bid, or because a figure labeled as our estimate differed from your own costs.

Plan charges are not refunded for a partial period, except where the law requires it; cancel to stop the next charge. If a report unlocked with a plan misses or misstates something material, the guarantee above applies and we return that report to your allowance or refund the equivalent report price, at your choice.

5.Your documents and your account

You keep all rights to the documents you upload and the reports generated from them. You grant us only the limited license needed to store, process, and display them to you and to provide the Service. Our handling of documents is described on the security page and in the privacy policy, which form part of these terms.

The Service is built for public solicitation documents. Do not upload protected health information, full Social Security numbers, or similar sensitive personal data, beyond what appears incidentally in a public solicitation.

You are responsible for keeping your sign-in email secure and for activity that occurs under your account. Tell us promptly if you believe your account has been accessed without permission.

If you send us suggestions or feedback about the Service, we may use them without any obligation to you.

6.Acceptable use

You agree not to:

• upload documents you do not have the right to use, or that contain classified information or Controlled Unclassified Information;
• upload malware, or attempt to interfere with, probe, or overload the Service;
• use automated means to create previews or accounts in excess of the published limits;
• resell the Service or present its output as your own product;
• use the Service in violation of any procurement rule, law, or the terms of a solicitation.

You confirm that you are not located in a country or territory subject to comprehensive United States sanctions, and that you are not on any United States government list of prohibited or restricted parties. You agree to comply with United States export control and sanctions laws in your use of the Service.

We may suspend or close accounts that violate these rules.

7.Accuracy, AI output, and disclaimers

The report is generated by software, including artificial-intelligence models, and is not reviewed by a person before you see it. We work hard to make extraction accurate and to cite every finding, but automated analysis of documents can miss, misread, or misplace information, especially in poor-quality scans, and the same package can produce slightly different wording on different runs. You must verify any finding you rely on against the source document before acting on it.

The Service is provided “as is” without warranties of any kind, express or implied, including any warranty of accuracy, completeness, fitness for a particular purpose, or non-infringement.

8.Limitation of liability

To the fullest extent permitted by law, WinMyBids will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost bids, or lost contracts, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the report giving rise to the claim.

9.Changes to the Service and these terms

We may change the Service, including its features and pricing, over time. If we make material changes to these terms, we will post the new version here with a new date and, for account holders, send an email notice. Continued use after the effective date means you accept the changes.

10.Termination

You may stop using the Service at any time. You can delete any package and its files from the dashboard, and you can close your account by emailing hello@winmybids.com. We may terminate or suspend access for violations of these terms. Sections 1, 5, 7, 8, 11, and 12 survive termination.

11.Governing law and disputes

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Delaware, and both parties consent to that jurisdiction. Before filing a claim, each party agrees to contact the other and attempt in good faith to resolve the matter informally for at least 30 days.

12.General

• Entire agreement. These terms, together with the privacy policy and security page, are the whole agreement between you and WinMyBids about the Service.
• Severability. If any part of these terms is found unenforceable, the rest remains in effect.
• Assignment. You may not assign these terms without our written consent. We may assign them as part of a merger, acquisition, or sale of the Service.
• Notices. We send notices to the email address on your account. You can send notices to us at hello@winmybids.com.
• Payments. Stripe processes payments, and Stripe’s terms apply to the payment itself.
• No waiver. If we do not enforce a part of these terms, we can still enforce it later.
